Nevada Attorney for Injured Workers

The NAIW lawyers represent injured workers who are seeking worker's compensation benefits. There are two primary hearing levels: First, an informal hearing before a Hearing Officer; Second, a formal hearing before an Appeals Officer. We represent workers at the administrative appeal level in front of the Appeals Officer. Claimant's appearing before the Hearing Officer do not need an attorney because the first hearing level is informal.

NAIW does not charge a fee for representation. Requests for representation are typically made in writing to the Appeals Officer during the administrative appeal process. NAIW is actually appointed by the Appeals Officer. After we receive an appointment from the Appeals Office or the Administrator (DIR), NAIW contacts our clients by mail to initiate the attorney-client relationship and begin the litigation process. An initial client meeting will be scheduled. This meeting is typically in our offices but may be conducted by phone.

Division of Industrial Relations

The mission of the Division of Industrial Relations (DIR) is to promote the health and safety of Nevada employees and the general public by providing workplace safety consultation and training, conducting inspections of businesses to ensure proper procedures relating to health and safety are being followed, and for confirming that injured employees are properly cared for following an accident on the job.

DIR encompasses six Sections: Legal, Mechanical Compliance (MCS), Mine Safety and Training (MSATS), Occupational Safety and Health Administration (OSHA), Safety Consultation and Training (SCATS), and Workers’ Compensation (WCS). MCS is responsible for safety relating to elevators, escalators, boilers, and pressure vessels; MSATS inspects and provides safety training for mine operations; Nevada OSHA enforces health and safety standards in the workplace; SCATS offers Nevada businesses free safety consultations; and WCS ensures that Nevada workers injured on the job receive the benefits for which they are entitled. The DIR Advisory Council, comprised of governor-appointed members, provides oversight and direction to the Division.
