Meaning of Column Headers

Case No.

The case number as assigned by the EMRB.

    Date

    The date that the complaint was filed with the EMRB. This gives an indication as to the age of the case.

      Complainant

      This is the name of the complainant. If there is more than one complainant the information may be abbreviated or truncated.

        Respondent

        This is the name of the respondent. If there is more than one respondent the information may be abbreviated or truncated.

          Notes

          This column provides information as to when documents are due, notes as to cases on deferment, or other meetings scheduled. For cases in the queue the particular queue (Las Vegas or Northern Nevada) is noted, along with the expected time for each party to present its case.

            Board

            If a case is scheduled is scheduled for a future Board meeting then this column will show the first date of that Board meeting. Also shown will be an abbreviation as to the nature of the action requested.

              Meaning of Categories

              Each case is assigned to one of a number of categories. The spreadsheet generally follows the flow of a case from the filing of initial pleadings to ultimate disposition.

                Cases Waiting for the Submittal of Initial Pleadings

                Cases listed here are waiting either for the filing of an answer or the filing of pre-hearing statements, which are filed with the EMRB subsequent to the filing of an answer.

                  Cases Pending a Motion to Dismiss

                  If a party has filed a motion to dismiss all or part of a case then the case will be listed in this category. The Notes column will then list the date(s) for the filing of any opposition or reply.

                    Cases Stayed Per Board Order at Request of Parties

                    Sometimes parties request that a case be stayed because they believe a settlement is imminent or for other reasons. Such cases would be listed under this category.

                      Cases Stayed Pending Outcome of Grievance Proceedings

                      Cases are listed under this category if the Board has agreed to defer a case pending resolution of any grievance or arbitration proceedings.

                        Cases Stayed Pending Court Proceedings in Other Cases

                        Sometimes a case is stayed due to a case filed in a court either on the same general case or sometimes even due to a totally different case if it is expected that the outcome of the court case may have an impact on the EMRB case.

                          Cases Diverted for a Settlement Conference

                          The Commissioner, upon Board approval, has the power to divert cases for the purpose of holding a settlement conference in an attempt to informally resolve some or all of the issues in a case. Any case so diverted would be listed under this category.

                            Cases in the Queue for Deliberation on Whether to Hold a Hearing

                            Once all the initial documents have been filed and any motions to dismiss have been decided by the Board, then a case will enter the queue. Cases sit in the queue until the Board decides whether to grant or not grant a hearing on the matter. The queue is divided into two geographical areas: Las Vegas and Northern Nevada. Cases in the queue will have notes as to the expected time for each party to present its case.

                              Cases Scheduled for a Hearing on the Merits

                              A case is listed under this category if the Board has agreed to grant a hearing, thus removing the case from the queue.

                                Cases Pending a Petition for Declaratory Order

                                Any petitions for a declaratory order will be listed under this category.

                                  Cases Pending a Motion for Rehearing

                                  If a party has requested that the Board rehear a case that has already been heard and decided upon, then the case will be listed under this category.

                                    Cases Waiting for Deliberation and Decision on Hearing Held

                                    A case will be listed under this category if the Board has heard (or reheard) a case but has not yet rendered a decision.

                                      Cases Pending a Stipulation to Dismiss

                                      A case will be listed under this category if the parties have submitted a stipulation to dismiss a case. This usually is due to a private settlement.
