As an exclusive bargaining agent, a union has a duty to fairly represent both members and non-members who are within the bargaining unit.  The EMRB has prepared the following strictly as a guide for employees and unions on the basic questions regarding the duty of fair representation.

Pre-Hearing Conference

Every case that is issued a Notice of Hearing first has a Pre-Hearing Conference held.  Like its name suggests, this is a conference held prior to the formal hearing before the Board.  The purpose of the Pre-Hearing Conference is to further refine the issues, discuss the calling of witnesses and the preparation of exhibits books, along with other technical details to better ensure that the hearing will go smoothly.  The Commissioner provides the parties with a Pre-Hearing Conference Checklist prior to the conference, which will serve as the agenda for the Pre-Hearing Conference.
